The Company may obtain the following types of information from or concerning you or your mobile phone device, which may include information that can be used to identify you as specified below (“Personally Identifying Information”):
The Company receives and stores any information you enter on the goFlow Service or provide to the Company in any other way. The types of Personally Identifying Information collected may include your full name, email address, phone number, birthday, Twitter and/or Facebook usernames, use information regarding your use of the goFlow Service, browser information, push notification name (if applicable), billing information (if applicable) and mobile device information. The Company automatically receives your location when you use the goFlow Service. The Personally Identifying Information you provide is used for such purposes as allowing you to set up a user account and profile that can be used to interact with other users through the goFlow Service, improving the content of the goFlow Service, customizing the advertising and content you and your friends see and communicating with you about specials and new features. The Company may also draw upon this Personally Identifying Information in order to adapt the goFlow Services to your needs and to research the effectiveness of the goFlow Services.
When you use the goFlow Service, the Company may send one or more cookies - a small text file containing a string of alphanumeric characters - to your computer that uniquely identifies your browser. The Company uses both session cookies and persistent cookies. A persistent cookie remains after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser help file directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, the goFlow Service may not function properly if the ability to accept cookies is disabled.
When you use the goFlow Service, the Company servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, one or more cookies that may uniquely identify your browser, your phone number, phone number you are requesting the status of and various status information. When you use the goFlow Service, the Company's servers log certain general information that the Company application sends whenever a message is sent or received, or if you update or request any status information, including time and date stamps and the mobile phone numbers the messages were sent from and to.
When you delete your User Submissions, they will be removed from the goFlow Service. However, you understand that any removed User Submissions may persist in backup copies for a reasonable period of time (but following removal will not be shared with others) or may remain with users who have previously accessed or downloaded your User Submissions.
If you submit Personally Identifiable Information to the Company through the goFlow Service, then the Company uses your personal information to operate, maintain and provide to you the features and functionality of the goFlow Service. Any billing information that may be collected from you will be deleted thirty (30) days after the termination of your account with the Company. Any Personally Identifiable Information or User Submissions that you voluntarily disclose on the goFlow Service becomes publicly available and may be collected and used by other users of the goFlow Service. Your name (as it is saved in another user's mobile phone address book or contact list) may be displayed to other users when you submit User Submissions through the goFlow Service and other users may contact you through the goFlow Service.
Your friends may see, for example, the location and time of each of your check-ins, name, email, phone number, photo, hometown, badges, links to your Twitter and Facebook accounts (if you have connected those accounts to your goFlow account), a list of your friends and tips you write. Individuals reading this information may use it or disclose it to other individuals or entities without the Company's control and without your knowledge. The Company therefore urges you to think carefully about including any specific information you may deem private in your User Submissions.
One of the key purposes of the goFlow is to help users learn about locations, events and brands that are relevant to them, and for these entities to provide information about themselves, their locations and events to users, as well as to reward users when they visit these location or events through offers and specials. Additionally, brands may have access to aggregated and anonymous data, such as anonymized check-in data (that is, not tied to individual users) of users that like their brand.
When you use the goFlow Service, certain information is public, such as your public user profile information, tips, likes, public photos, lists that you create and lists of friends, and may be searchable by search engines and be shared with or disclosed to third parties. The Company may also share or disclose aggregated and anonymous data, such as anonymized check-in data (that is, not tied to individual users), to third parties for analytical or other purposes.
Other users of the goFlow Service may see your User Submissions in a way that is consistent with the use of the goFlow Service. If another user has your mobile phone number stored in their mobile phone address book or contact list, they will be able see your User Submissions unless you have chosen to block such user.
The Company does not sell or share your Personally Identifiable Information (such as mobile phone number) with other third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. The Company may share your Personally Identifiable Information with third party service providers to the extent that it is reasonably necessary to perform, improve or maintain the goFlow Service. The Company enters into relationships with a variety of businesses and works closely with them. In certain situations, these businesses provide services to you, sell items or provide promotions to you through the goFlow Service. In other situations, the Company provides services or sells products jointly with these businesses. You can easily recognize when one of these businesses is associated with your transaction, and the Company will share your Personally Identifying Information that is related to such transactions with that business.
The Company may share non-personally-identifiable information (such as anonymous user usage data, referring/exit pages and URLs, platform types, asset views, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions and/or functionality on the goFlow Service. The Company may collect and release Personally Identifiable Information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright Law) or international law (including laws outside your country of residence) or to respond to a court order, subpoena, or search warrant or equivalent, or where in the Company's reasonable belief, an individual's physical safety may be at risk or threatened. The Company also reserves the right to disclose Personally Identifiable Information and/or non-personally-identifiable information that the Company believes, in good faith, is appropriate or necessary to enforce the Company's Terms of Service, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the goFlow Service or the Company's servers, and to protect the rights, property or safety of the Company, the Company's employees or users or others. The Company's release of Personally Identifying Information under the conditions described in this paragraph may include exchanging information with other companies and organizations (including outside of your country of residence) for fraud protection and credit risk reduction.
The Company uses commercially reasonable physical, managerial and technical safeguards to preserve the integrity and security of your personal information. The Company cannot, however, ensure or warrant the security of any information you transmit to the Company and you do so at your own risk. Using unsecured wifi or other unprotected networks to submit User Submissions through the goFlow Service is never recommended. The Company makes commercially reasonable efforts to ensure the security of the Company's systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any of the Company's physical, technical or managerial safeguards. If the Company learns of a security systems breach, then the Company may attempt to notify you electronically so that you can take appropriate protective steps. The Company may post a notice through the goFlow Service if a security breach occurs.
Protecting the privacy of young children is especially important. For that reason, the Company does not knowingly collect or maintain Personally Identifiable Information or non-personally-identifiable information on the goFlow Service from persons under 16 years of age, and no part of the goFlow Service is directed to or intended to be used by persons under 16. If you are under 16 years of age, then please do not use the goFlow Service at any time or in any manner. If the Company learns that Personally Identifiable Information of persons under 16 years of age has been collected on the goFlow Service, then the Company may deactivate the account and/or make the User Submissions inaccessible.
In the event that the Company is acquired by or merged with a third party entity, the Company reserves the right to transfer or assign the information the Company has collected from its users as part of such merger, acquisition, sale or other change of control. In the unlikely event of the Company's bankruptcy, insolvency, reorganization, receivership, assignment for the benefit of creditors or the application of laws or equitable principles affecting creditors' rights generally, the Company may not be able to control how your personal information is treated, transferred or used. If the Company or substantially all of its assets are acquired, or in the unlikely event that the Company goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party.
